The Role of Non-governmental Organisations in Individual Communication Procedures before the UN Human Rights Treaty Bodies

ABSTRACT:

The aim of this article is to analyse different modes of Non-governmental organisations (NGOs) participation in individual communication procedures before the United Nations (UN) human rights treaty bodies. Although treaties laying down provisions on communication procedures remain silent as to the role of NGOs, in practice treaty bodies allow for some forms of their participation. In the light of jurisprudence of three bodies with the most extensive record in this matter, namely the Human Rights Committee, the Committee on the Elimination of Racial Discrimination and the Committee on the Elimination of Discrimination against Women, the article will discuss the role of NGOs acting as representatives of the petitioner, in their capacity as entities submitting communication on behalf of the victim, entities submitting individual complaints and as third parties (authors of amicus curiae briefs). The article will show that the jurisprudence of certain bodies has evolved as regards NGO participation, which proves that their position in individual communication procedures has become stronger.

Katarzyna Sękowska-Kozłowska, Ph.D. – senior researcher at the Poznań Human Rights Centre of the Institute of Legal Studies of the Polish Academy of Sciences. Her Ph.D. thesis on the UN Committee on the Elimination of Discrimination against Women (CEDAW) was published in Polish (Komitet ONZ ds. Likwidacji Dyskryminacji Kobiet - ustrój, kompetencje, funkcjonowanie, Toruń 2011). Her main fields of research are discrimination issues with special focus on gender discrimination and the UN human rights mechanisms.
